Explanatory Note

This Bill authorizes the erection of a permanent building and associated fencing on Halifax’s Central Common to support its aquatic area and to provide community space.

An Act to Amend Chapter 39
of the Acts of 2008,
the Halifax Regional Municipality Charter

Be it enacted by the Governor and Assembly as follows:

1 Chapter 39 of the Acts of 2008, the Halifax Regional Municipality Charter, is amended by adding immediately after Section 66A the following Section:

    66B (1) The Municipality may erect on the Central Common of Halifax one permanent building to be used exclusively to support the aquatic area on the Halifax Common and to provide space for community use.

    (2) The Municipality may erect on the Central Common fencing associated with the building referred to in subsection (1).

    (3) A building or structure on the Central Common erected pursuant to subsection (1) or (2) may continue to be used for its original purpose but no change in the use of that building or structure may be made unless approved by the Governor in Council and, when the building or structure is no longer required for that purpose and the Governor in Council has not approved its use for another purpose, the land occupied by that building or structure must revert to public open space.
